How to Respond to a Divorce Petition
If your spouse files for divorce, you will receive a divorce petition in the post. From this point forward, you are known as the “respondent”, while your husband or wife is the “petitioner.”
Once the petition arrives, you have 8 days to complete and return the acknowledgement of service form to the court. If you do not respond within this time, the divorce may proceed without your input.
First Steps After Receiving a Divorce Petition
- Read the petition carefully
Make sure that details such as names, dates of birth, and addresses are all correct. - Check Parts 5 and 6
These sections, known as The Facts and The Statements of Case, explain the grounds on which your spouse is seeking divorce. They may also set out any allegations made against you. These are crucial to understand before responding. - Act quickly
The clock starts from the day you receive the petition. Even if you agree to the divorce, you should still take advice to ensure you are not unfairly disadvantaged.
